photography terms & conditions

These Photography Terms & Conditions ("Terms") govern all photography services provided by xSquared, LLC, doing business as xSquared Photography ("Photographer," "we," "our," or "us"). By booking a session, paying a booking fee, or using our services, you ("Client") agree to these Terms.
1. Booking & Payment
A session is not confirmed until the required booking fee or deposit has been received.
Unless otherwise agreed in writing, all remaining balances are due on or before the scheduled session date.
Prices are subject to change without notice; however, confirmed bookings will be honored at the agreed-upon rate.
2. Cancellations & Rescheduling
Clients must notify us as soon as possible if they need to cancel or reschedule a session.
Booking fees and deposits are non-refundable unless otherwise stated in a signed agreement.
Rescheduling requests are subject to Photographer availability.
Outdoor sessions may be rescheduled due to unsafe weather or conditions that would significantly impact the quality of the session.
3. Client Responsibilities
The Client is responsible for:
- Arriving on time.
- Obtaining any necessary permissions or venue approvals.
- Ensuring participants are prepared and dressed appropriately.
- Supervising children and minors during the session.
Delays caused by the Client may reduce available photography time.
4. Photography Services
The Photographer will make reasonable efforts to capture the session professionally and artistically but cannot guarantee any specific pose, expression, moment, or image.
Photography is an artistic service, and final images are delivered based on the Photographer's creative judgment.
5. Image Selection & Editing
Delivered photographs are professionally edited in the Photographer's signature style.
To ensure the quality and artistic integrity of our work, RAW (unedited) image files are retained exclusively by xSquared Photography and are not released under any circumstances.
Additional editing requests may be subject to additional fees.
6. Delivery
Images will be delivered electronically through an online gallery unless otherwise agreed.
Delivery time varies depending on the type of session and workload. Estimated turnaround times will be communicated when possible but are not guaranteed.
Clients are encouraged to download and back up their purchased images promptly after delivery.
7. Copyright
All photographs remain the exclusive property of xSquared, LLC and are protected by United States copyright law.
The purchase of photographs does not transfer copyright ownership.
Clients receive a personal, non-exclusive license to download, print, and share purchased images for personal, non-commercial use unless otherwise stated in writing.
Commercial use, resale, editing, alteration, or distribution of images without prior written permission is prohibited.
8. Social Media
Clients are welcome to share purchased images on personal social media accounts.
We appreciate, but do not require, credit to xSquared Photography when images are shared.
Images may not be altered, filtered, or edited in a manner that misrepresents the Photographer's work without written permission.
9. Photographer Portfolio & Marketing
Unless otherwise agreed in writing, the Client grants permission for the Photographer to use photographs from the session for portfolio display, marketing, advertising, website galleries, social media, competitions, educational purposes, and promotional materials.
If a Client prefers not to have their images used, they must notify the Photographer in writing before the session.
10. Limitation of Liability
While every reasonable effort is made to safeguard images and equipment, the Photographer shall not be liable for circumstances beyond reasonable control, including but not limited to severe weather, equipment failure despite reasonable precautions, venue restrictions, acts of nature, illness, emergencies, or other unforeseen events.
If circumstances prevent the completion of services, liability shall be limited to the amount paid by the Client unless otherwise required by law.
11. Gallery Availability
Online galleries may remain available for a limited time.
Clients are responsible for downloading and safely storing their purchased images.
Long-term image archiving is not guaranteed.
12. Independent Contractor
The Photographer is an independent contractor and is solely responsible for determining the artistic approach, equipment, editing style, and methods used to provide photography services.
13. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Hawaiʻi without regard to its conflict of law principles.
14. Changes to These Terms
xSquared Photography reserves the right to update these Terms at any time. Updated versions will be posted on this website and become effective upon publication.
